So I will try and shorten the long version of this journey but when we had a spend down of assets we signed over Aunties life insurance policy to the Funeral Director and since that time we have learned just recently that the funeral director has passed away and no one will be taking over his clients etc. etc. Since this all just happened within the past few weeks we have not reached out to the Funeral home yet but Aunties medicaid renewal application has come up and the NH is aware of this so not sure what the next step is. The NH business manager is willing to work with us but she has never had this happen since she has been there and we want to make sure things are handled properly. We thought about signing the insurance over to another local funeral home however not sure if that is even possible at this point. Thanks for any input

Can you please clarify if you made the funeral home business entity the beneficiary? I'm hoping you don't mean you "signed it over" to him personally...

I think Medicaid has seen all sorts of things. If it was signed over to the funeral home business, I think Medicaid will be flexible but I would ask whoever is in temporary charge of the funeral home business to write a letter confirming what happened and when. Someone from their business office should be able to provide this. Don't give this to Medicaid unless it is asked for.

If you signed this over I am certain it doesn't happen without a CONTRACT. Take that contract to to whomever is handling the winding down of this business. In lieu of that do reach out to an attorney with this question. I never really heard of "signing over" a policy. I have only heard of pre paying. And I am not certain what happens even then with the death of owner and shutdown of a business.

No the Funeral home was made the beneficiary of the policy and most of her services were paid for with the exception of picking her casket which she refused to do.

Was this a Medicaid Funeral Trust? You should have gotten a policy if so. In Moms, the Funeral Home was the beneficiary. I would think you could call the insurance company and see how the beneficiary can be changed. I am sure this is not uncommon. I hope you have the contract with the Funeral home too listing what was covered. Your problem will be, the new Home maybe more expensive so Moms estate will need to pay the difference that the policy does not cover. When picking Moms casket I felt what was good for Dad, that she picked out, was good for Mom.
