My ex-husband was killed in a mining accident. We had a disabled daughter but we were only married for 7 years. Since we had a disabled child that I was taking care of, should I be able to get benefits from his social security?

No you would have had to be married at least 10 years.
I would think your daughter should be getting something.

This is definitely a question for Social Security itself.
I don't know anyone on AC who is an expert in benefits. Igloo certain comes closest and I hope she is around. Meanwhile I will refer you to SS phone system. You will be on hold a long time, BUT I have found in past years that they are kind and efficient when finally I get them.

I think when you call you can leave your number and they will call back so you are not on hold forever. And they do call back

It's 10 years, for each marriage (if married more than once).

I think that is for a spouse. She should be able to get benefits for the child.

Call SS for guidance on applying for disability for your daughter if she may be eligible. She may alternately be eligible for SS supplemental security income, which is currently a bit over $900/month

You and or the child may be eligible for several benefits. So, you should contact Social Security to make sure that you select the right one(s).

Spousal benefit, survivor benefit, survivor child in care benefit, or disability benefit.

The spousal benefit, if I recall correctly, requires ten years of marriage, but child in care is only one year.

How old is your child. If under 18, yes child is entitled to his SS. But if over 18, you should be going for Social Security Disability. Your husbands earnings will be considered. As said, if over 18, you should be able to get Suppliment Security Income (SSI). With that comes Medicaid.

If you have not done it, you need to talk to your County Disabilities Dept and see what resourses are available to you. Also, Social Services for SSI and Social Security for SSD.
